im sitting here in the park on a unsecured router from some1 i have no idea whos it is,is this legal?im not hacking anything and thelibrary is right acrosshe street.........now fi was to guess the key it would be illegal correct?

It's not illegal if you're stumbling on it.  If you intentionally drive around looking for open wifi connections you could get arrested, last I remember.  Now, if you're in a public park and someone has their wifi overlapping into that area and it's unsecured... I'd worry if they actually lock their doors or not.

it over lapped in the park was a weak signal but i didnt see no diff in the speed of connection

It isn't illegal, but is a violation of most ISP's ToS contracts for who ever has the AP to leave it open like that.

Basically, the wifi owner has liability for its access. You do not.

For example, if you are using Limewire and that person's ISP flags them for illegal use, it's their fault for not securing th' network.

This is one of those depends questions.  Nationally, I am unaware of any federal law that explicitly says it is illegal; however, this differs with states and municipalities, as in my own state it can get you arrested yet in the next state over nothing will happen.

One of the problems is that when much of the federal law concerning hacking and computer security was written, things like 802.X  weren't even considered at the time as they didn't exist and there's some question on whether any of current federal law is applicable. While some communities and states have made an effort to address this legal grey area, it's been rather piecemeal at best.

For safeties sake I would suggest against leaching internet from a neighbor and check what your local and state laws say on the issue.
